Welcome to Aveya (“Aveya,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Aveya mobile application (the “App”), the Aveya safety jewelry device (the “Device”), our website at aveyawear.com (the “Site”), and any related alert, notification, and SMS/text messaging services (collectively, the “Services”). By creating an account, activating your Device, or enrolling in our SMS alert program, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
1. Description of Services
Aveya provides wearable jewelry embedded with a discreet alert trigger. When activated, the Device sends a signal to the App, which may notify your designated emergency contacts and/or trigger an SMS text message alert through our messaging system. The Services are a personal safety aid and are not a substitute for calling 911 or other local emergency services.
2. SMS Alert Program — Opt-In Consent
2.1 Enrollment and Consent
By providing your mobile phone number during account setup, activating Device alerts, or checking the SMS consent box, you expressly consent to receive text messages from Aveya related to:
- Emergency and safety alerts triggered by your Device or App
- Account, activation, and device-status notifications (e.g., low battery, connectivity issues)
- Alerts sent to contacts you designate as emergency contacts on your behalf
This consent is a condition of using the safety-alert function of the Services, since SMS is a delivery channel for the alerts you are requesting. Consent to receive informational/marketing texts (if any are offered in the future) is separate and will require its own opt-in.
Consent is not a condition of purchasing the Device. You may purchase and use the physical jewelry without enrolling in SMS alerts, though the App and/or SMS channel may be required for full alert functionality.
2.2 Message Frequency
Message frequency varies based on your Device usage and alert activity. You may receive one or more messages at the time of an alert event, plus occasional account or Device-status messages. Message frequency is not fixed or recurring on a schedule.
2.3 Message and Data Rates
Message and data rates may apply. Aveya does not charge for SMS alerts, but your mobile carrier’s standard messaging and data rates apply based on your phone plan.
2.4 Opt-Out
You can opt out of SMS alerts at any time by texting STOP to the number you received messages from. After opting out, you will receive one final confirmation message, and no further messages will be sent. Opting out of SMS may disable the SMS-based alert channel — we recommend keeping the App notification channel active as your primary alert method if you disable SMS.

2.6 Supported Carriers
The SMS program is available on major U.S. carriers. Aveya and its messaging partners are not liable for delayed or undelivered messages caused by carrier network issues, dead zones, device settings, or circumstances outside our control.
2.7 Re-Enrollment
If you opt out and later wish to resume SMS alerts, you must re-enroll and provide consent again through the App or Site.
3. Emergency Services Disclaimer
Aveya is a supplemental safety tool. It relies on your Device being charged, paired, and connected; your phone having signal and battery; and third-party carrier and app-store infrastructure functioning normally. We do not guarantee that alerts will be delivered in every circumstance and Aveya is not a replacement for contacting 911 or local emergency responders directly. You are responsible for maintaining your Device, keeping the App updated, and testing your alert setup periodically.
4. Accounts
You must provide accurate registration information, including a valid mobile number if enrolling in SMS alerts. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
5. Emergency Contacts
You are solely responsible for obtaining any necessary consent from individuals you designate as emergency contacts before adding their phone numbers or information to your account, since those individuals may also receive SMS or app alerts on your behalf.
6. Acceptable Use
You agree not to misuse the Services, including by submitting false alerts for testing without disclosure to your contacts, attempting to interfere with the Device/App/SMS infrastructure, or using the Services in violation of applicable law.
7. Intellectual Property
All content, trademarks, and technology associated with Aveya, the App, and the Site are owned by Aveya or its licensors. You may not copy, reverse-engineer, or redistribute any part of the Services without our written permission.
8. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVEYA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES, INCLUDING FAILED OR DELAYED ALERT DELIVERY.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
